"The REIQ's position is that its members will not complete the declaration on a seller's behalf as they are not in a position to assess sustainability features such as energy and water efficiency. The obligation for completion rests with the seller of the property. " Source REIQ.
Agents may be liable for fines of up to $10,000 and Sellers of up to $2,000 for breaches of the new regulations.
To assist with compliance of the new Sustainability Declaration requirements we can:
- Work with your clients to complete the Sustainability Declaration
- Arrange for your Sellers to sign the Declaration
- Provide you with an electronic copy
- Help you bring your current signs and window cards into line

What can I do now to ensure compliance?
Firstly your sellers need to be made aware of the necessity to have the Sustainability Declaration completed. You can use our standard letter to owners.
Window cards, customised signs, websites, flyers and brochures will all need to highlight where a copy of the Sustainability Declarations is available. A copy of the Declaration must be made available to any prospective purchaser who requires one and be on display at open homes.
For online listings it is recommended you copy and paste the following (or something similar) onto all your online listings:
"From the 1st of January 2010 a copy of the Sustainability Declaration for this property will be available from the Agent. For more information on the requirements for a Sustainability Declaration visit www.sustainabilityreports.com.au"
Who Can Complete the Sustainability Declaration?
Your Seller (or a person authorised under a power of attorney or other statutory power) must sign the Sustainability Declaration. In general this means the person who signs your PAMD 22A must sign the Sustainability Declaration.
You, as their Agent, are NOT able to sign the form. We at Sustainability Reports only assist your owner in completing the form.
How To Book
It is preferable that your Seller make the booking direct with us as they are required to sign off on the Sustainability Declaration. Agents can book on behalf of Sellers, however agents will then be liable for payment. We service all of Queensland including Regional and Remote parts of the State.
